The basics: Indiana dog bite laws

On Behalf of | Nov 6, 2025 | Dog Bites

Indiana dog bite laws are designed to balance the rights of victims with the realities of dog ownership. While some states follow a strict liability rule that automatically holds owners responsible for any bite, Indiana takes a more nuanced approach.

Essentially, the law considers where a particular attack occurred, the circumstances surrounding it and whether the victim was lawfully present on the property at issue at the time that they sustained harm. Understanding these basics can help dog bite victims and pet owners alike make more informed decisions about their rights and obligations.

Not quite a “one bite” rule

Under Indiana law, dog owners are generally held strictly liable if their dog bites someone who was acting lawfully—such as a postal worker, delivery driver or public safety employee—while performing their duties. In these cases, the victim does not need to prove that the owner knew that their dog was dangerous or had acted aggressively before.

For all other situations, Indiana follows a “one-bite” or negligence-based rule. This means a dog owner may only be held liable if they knew or should have known that their dog had dangerous tendencies. Evidence of prior aggressive behavior—such as snapping, growling or previous bites—can demonstrate that the owner should have taken precautions. If the owner failed to restrain or control the dog despite knowing it posed a risk, they can be held financially responsible for the victim’s injuries.

Victims must also show that they were legally on the property where the attack occurred. If someone was trespassing or provoking an animal, their owner may not be liable. However, when a person is lawfully visiting a public area or invited onto private property, they have the right to expect reasonable safety.

An experienced legal team can help those who have recently been harmed as a result of unprovoked animal attacks to seek compensation and justice. Indiana’s dog bite laws aim to encourage responsible pet ownership while ensuring that victims receive justice whenever reasonably preventable attacks occur.
